1. Agreement to Terms
By creating an account, generating an API key, or otherwise accessing or using the Gramm Inc. API and related services (the “Service”), you (“Customer” or “you”) agree to be bound by these Terms of Service (“Terms”). If you are accepting on behalf of an organization, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.
2. Service Description
Gramm Inc. provides an API for electricity demand forecasting, grid data, and related analytics. Forecast data may be derived from proprietary models, third-party sources, government agencies, and independent data providers. No guarantee is given regarding the accuracy, availability, completeness, or suitability of any data or forecast.
3. Accounts & API Keys
- You must provide accurate account information and keep it current.
- You are responsible for all activity under your account and API keys.
- Keep API keys confidential. Notify us immediately if you suspect unauthorized use.
- We may suspend or terminate accounts that violate these Terms.
4. Acceptable Use
Your use of the Service must comply with these Terms and with our separate Acceptable Use Policy, which we may update independently to reflect new operational guidance and applicable regulatory requirements.
In particular, you agree not to:
- Exceed your plan’s rate limits or circumvent access controls.
- Redistribute, resell, or sublicense raw API data without written permission.
- Reverse-engineer, decompile, or attempt to extract the underlying models, algorithms, or training data.
- Systematically collect or store API outputs to build a competing forecast product or derivative model.
- Use API outputs as training data for machine learning models, neural networks, or statistical models without a separate Data License agreement.
- Redistribute API outputs to third parties as a standalone data feed or competing service. (Using forecasts to inform your own operational or trading decisions is permitted and encouraged.)
- Use robots, crawlers, scrapers, or automated tools to harvest, collect, or extract data from the Service beyond normal API usage.
- Store unaltered copies of API responses beyond 30 days unless required for audit or compliance purposes.
- Use the Service for any unlawful purpose or in violation of export controls.
- Interfere with or disrupt the integrity or performance of the Service.
5. Billing & Subscription
- Paid plans are billed monthly via Stripe. Fees are non-refundable except as required by law.
- We may change pricing with 30 days’ notice. Continued use after the change constitutes acceptance.
- Downgrade to the Free plan at any time by canceling your subscription.
- We may suspend access for overdue payments after 7 days’ written notice.
6. Forecast Accuracy Disclaimer
GRAMM INC. MAKES NO EXPRESS OR IMPLIED WARRANTIES, GUARANTEES, OR AFFIRMATIONS THAT FORECASTED ENERGY DEMAND DATA, GRID CONDITIONS, OR RELATED PREDICTIONS WILL OCCUR AS STATED. GRAMM INC. SHALL HAVE NO RESPONSIBILITY OR LIABILITY WHATSOEVER FOR ANY INCONSISTENCY, INACCURACY, OR OMISSION IN FORECASTED OR PREDICTED DATA.
ACCURACY METRICS PUBLISHED ON THE GRAMM INC. WEBSITE (SUCH AS MAPE, RMSE, OR IMPROVEMENT PERCENTAGES) DESCRIBE HISTORICAL MODEL PERFORMANCE ON BENCHMARK DATASETS AND DO NOT CONSTITUTE A GUARANTEE OF FUTURE PERFORMANCE ON ANY SPECIFIC GRID, TIMEFRAME, OR USE CASE.
THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL JUDGMENT. CUSTOMER IS SOLELY RESPONSIBLE FOR ALL OPERATIONAL, FINANCIAL, AND TRADING DECISIONS MADE BASED ON DATA OR FORECASTS PROVIDED BY THE SERVICE. GRAMM INC. OFFERS NO FINANCIAL, INVESTMENT, OR TRADING ADVICE.
COMPARATIVE STATEMENTS ON THE GRAMM INC. WEBSITE (E.G., “MOST ACCURATE,” “LOWEST ERROR,” OR SIMILAR SUPERLATIVES) REFER TO PUBLISHED BENCHMARK COMPARISONS AGAINST ISO-REPORTED BASELINE FORECASTS FOR THE SPECIFIC EVALUATION WINDOWS AND REGIONS DESCRIBED IN THE ACCOMPANYING METHODOLOGY. SUCH STATEMENTS DO NOT CONSTITUTE A REPRESENTATION THAT THE SERVICE WILL OUTPERFORM ALL OTHER COMMERCIALLY AVAILABLE FORECAST PRODUCTS IN ALL CIRCUMSTANCES, REGIONS, OR TIME PERIODS. PAST BENCHMARK PERFORMANCE IS NOT A GUARANTEE OF FUTURE RESULTS.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, TITLE, SECURITY, COMPATIBILITY, OR UNINTERRUPTED SERVICE.
GRAMM INC. DOES NOT WARRANT THAT THE SERVICE OR DATA WILL BE FREE FROM BUGS, DEFECTS, OR ERRORS, OR THAT THE SERVICE WILL BE ACCESSIBLE WITHOUT INTERRUPTION. DATA MAY BE DERIVED FROM THIRD-PARTY SOURCES AND NO GUARANTEE IS GIVEN REGARDING THE ACCURACY OR AVAILABILITY OF THIRD-PARTY DATA.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PARTY SHALL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, STATUTORY, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, PROFITS, GOODWILL, DATA, BUSINESS OPPORTUNITIES, ANTICIPATED SAVINGS, OR TRADING LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
GRAMM INC.’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED: (A) FOR FREE AND DEVELOPER PLAN CUSTOMERS, THE GREATER OF THE TOTAL FEES PAID IN THE TWELVE (12) MONTHS PRECEDING THE EVENT OR ONE HUNDRED DOLLARS ($100 USD); (B) FOR TEAM AND GROWTH PLAN CUSTOMERS, THE GREATER OF THE TOTAL FEES PAID IN THE TWELVE (12) MONTHS PRECEDING THE EVENT OR TEN THOUSAND DOLLARS ($10,000 USD); OR (C) FOR ENTERPRISE CUSTOMERS, THE AMOUNT SET FORTH IN THE APPLICABLE ORDER FORM OR MASTER SERVICES AGREEMENT.
THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
9. Indemnification
You agree to defend, indemnify, and hold harmless Gramm Inc., its officers, directors, employees, and agents from any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use of the Service, (b) any application or product you build using the Service, (c) any operational, financial, or trading decisions made based on data or forecasts provided by the Service, or (d) your violation of these Terms.
Gramm Inc. will indemnify Customer against third-party claims alleging that the Service infringes a valid U.S. patent or copyright, provided Customer gives prompt written notice, grants sole control of the defense, and provides reasonable cooperation.
10. No Reliance; Independent Verification
Customer acknowledges that forecast data is inherently uncertain and agrees not to use the Service as the sole basis for any decision that could result in financial loss, bodily injury, or property damage. Customer agrees to maintain independent verification and backup systems appropriate to its use case.
Customer assumes the entire risk related to its use of the Service and any data or forecasts obtained through the Service.
Intended use and scope of fitness. The Service is designed for electricity demand forecasting on supported U.S. ISOs and RTOs at the resolutions and horizons documented in the API reference (hourly or sub-hourly resolution where available; horizons scoped by grid, plan, and validation status). The Service is not designed for and is not warranted for: (a) sub-minute or tick-level trading control loops, (b) safety-critical automatic dispatch or grid-control automation without independent backup feeds and human-in-the-loop approval, (c) markets, geographies, fuels, or commodities other than those documented as supported, or (d) any use case identified as out-of-scope in the Acceptable Use Policy. Customer is solely responsible for determining whether the Service is fit for Customer’s intended use.
11. Service Level
Gramm Inc. targets 99.9% monthly uptime for the forecast API on Developer, Team, and Growth plans. Uptime is calculated as the percentage of minutes the API returns non-error responses. Planned maintenance (with 48 hours’ notice) and upstream ISO/RTO data source outages are excluded. All self-serve plans (Free, Developer, Team, Growth) are provided on a commercially reasonable efforts basis without binding uptime guarantees or automatic service credits. Enterprise customers may negotiate binding SLA commitments, including uptime credits, as part of a commercial agreement.
12. Termination
- Either party may terminate with 30 days’ written notice.
- We may suspend or terminate immediately for Terms violations or non-payment.
- Your access to the Service terminates automatically if you institute, or knowingly assist in instituting, copyright or patent litigation against Gramm Inc. alleging that the Service or any forecast produced by the Service infringes your intellectual-property rights.
- On termination, your API keys are revoked and cached data is deleted within 30 days.
- Sections 6–10 and Section 15 (disclaimers, liability, indemnification, no-reliance, feedback) survive termination.
13. Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS UNDER ITS STREAMLINED ARBITRATION RULES, BEFORE A SINGLE ARBITRATOR IN WILMINGTON, DELAWARE. THE ARBITRATOR’S AWARD SHALL BE FINAL AND ENFORCEABLE IN ANY COURT OF COMPETENT JURISDICTION.
YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.
Exception: either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm. Claims must be brought within one (1) year after the cause of action arose.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email and an in-dashboard notice at least 30 days before they take effect. Continued access to the Service after the effective date constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service before the effective date.
15. Feedback
If you send Gramm Inc. suggestions, bug reports, accuracy observations, feature requests, or other feedback about the Service, you grant Gramm Inc. a perpetual, worldwide, irrevocable, royalty-free license to use, reproduce, and incorporate that feedback into the Service or any related products without obligation, attribution, or compensation. You retain no proprietary rights in the feedback itself; nothing in this section transfers ownership of any unrelated work product or pre-existing intellectual property you may reference when providing feedback.
Privacy Policy
What We Collect
- Account data: Email, name, and organization when you sign up.
- API usage: Request counts, timestamps, and query parameters (not the content of responses).
- Payment data: Processed by Stripe. We never see or store your full card number.
- Technical data: IP address, browser type, and device info for security and rate limiting.
- TOS acceptance records: Timestamp, terms version, and IP address when you agree to these Terms.
How We Use Your Data
- Authenticate your API requests and enforce rate limits.
- Process payments and manage your subscription.
- Send transactional emails (account verification, billing, usage alerts).
- Improve our forecasting models and API performance.
We do not sell your data or share it with advertisers.
We may create and use aggregated, de-identified data derived from your usage of the Service for analytical purposes, benchmarking, and service improvement. Aggregated data does not identify you or your organization.
Data Storage & Security
- Database: SOC 2 Type II certified provider. Data encrypted at rest (AES-256) and in transit (TLS 1.3).
- API keys: Stored as SHA-256 hashes. The plaintext key is shown once on creation and never stored.
- Payments: PCI DSS Level 1 certified processor. We never see or store your full card number.
- Hosting: SOC 2 Type II certified infrastructure.
- Caching: SOC 2 Type II certified. Ephemeral data with automatic expiry.
Data Retention
- Account data: Retained until you delete your account.
- API usage logs: Aggregated counters retained for 35 days (monthly), then automatically deleted.
- Forecast data: Retained for 90 days, then archived or deleted.
- Payment records: Retained as required by tax law (typically 7 years).
- TOS acceptance records: Retained for the duration of the account plus 3 years.
Your Rights
- Access: Request a copy of your data at any time.
- Deletion: Request account deletion via dashboard settings or email.
- Portability: Export your API usage data in JSON format.
- Correction: Update your profile data in dashboard settings.

Cookies
We use essential cookies only, authentication session cookies managed by our auth provider. No tracking cookies, no analytics cookies, no third-party advertising cookies.
U.S. Resident Privacy Rights (CCPA)
Gramm has not sold or shared personal information for cross-context behavioral advertising in the preceding 12 months. Categories of personal information collected:
- Identifiers: Name, email address, organization name, IP address.
- Commercial information: Subscription plan, payment history.
- Internet activity: API request logs, browser type, device info.
- Professional information: Job title and organization (if provided).
California residents may request disclosure, deletion, or correction of personal information by emailing hello@gramm.ai. We will respond within 45 days. We do not discriminate against users who exercise their privacy rights.
Do Not Track
Gramm does not track users across third-party websites. We do not respond to Do Not Track browser signals because we do not engage in the tracking those signals are designed to prevent.
Children's Privacy
The Service is not directed at individuals under 18. We do not knowingly collect personal information from minors. If we become aware that a minor has provided personal information, we will promptly delete it.
